1. Acceptance of Terms of Use:
Each time you use or access this website, you agree to be bound by these Terms of Use, as amended from time to time with or without notice to you. You can view the most current version of the terms of use on this page at any time. We reserve the right, at our sole discretion to update, change or replace any part of these terms of sale by posting updates or changes to our website. It is your responsibility to check our website periodically for updates. Your continued use of our site after these changes have been posted constitutes acceptance of those changes.
2. Our Service:
Whilst all items are offered for sale in good faith, occasionally for reasons beyond our control, we may not be able to fulfil your order. Therefore, a sale agreement will only exist between you and Blue Mango Creations when you receive an email confirming your order has been dispatched. If for any reason an item/s is/are unavailable, we will contact you to offer a substitute or refund as soon as possible.
We reserve the right to refuse service to anyone for any reason at any time.
As some items are 'one-offs' there may be occasions where the items are added to multiple carts and checked out at the exact same time. If this should occur then we will contact you and process the order that was received first (time-wise). An agreement on how to proceed with the other order will be made and either a refund offered or an alternative item selected (with agreement).
3. Products:
Many of the items on the website have limited quantities available, this is due to them being handmade and in keeping with our idea of limited editions of unique items.
All content on this website including text and photographs are protected by copyright which is owned by Blue Mango Creations.
We have made every effort to display items as accurately as possible. Please allow for slight variations in colour due to the differences in device screens. Please also remember that many of the materials we use are natural so may have minor imperfections - we believe this adds to the uniqueness of the items. We do not sell anything that we would not be happy to wear ourselves.
5. Description and Pricing:
The prices payable for each item are set out on our website. All prices are shown and charged in GBP (£).
We have tried to make descriptions as clear, simple and as accurate as possible. Please note measurements are approximate and may vary by 1cm/1g either way.
Occasionally there may be information on our site that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions & offers, delivery costs and availability. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information or cancel items at any time without any prior notice (including after you have submitted your order).
You may notice that our online prices vary to those offered at a physical sale, this is due to additional costs involved with selling online (fees, postage, packaging etc). As always we try to keep our prices as low and as competitive as possible. Please remember that these are not items you can walk into a shop and purchase, they are unique and only one or a limited amount are available.
6. Payment:
We must receive payment in full for your order before it can be accepted. Once your payment has been received, cleared and stock level checked your order will be processed and subsequently dispatched.
Blue Mango Creations uses both card payments and PayPal as their preferred method of payment. You do not need a bank card to use PayPal.
7. Delivery and Delivery Charges:
All delivery details and delivery charges on this site refer to delivery within the UK only. We are happy to offer worldwide postage but this needs to be agreed in advance so all costs (including taxes) are transparent. If you are outside the UK and wish to make a purchase or enquiry, please contact us before placing an order.
You will have the option to select the following for delivery:
Royal Mail Signed For or Tracked (second class) - £3.50 (this is for orders up to £50)
Royal Mail Signed For or Tracked (first class) - £3.95 (this is for orders up to £50)
Royal Mail Tracked48 with Signature - £5.50 (orders over £50)
Orders over £100 - free
We aim to dispatch your order within two working days from receipt of your order. If your order is received on Friday, Saturday or Sunday it will be dispatched by the following Tuesday.
We use Royal Mail (in the first instance) and occasionally alternative carriers as our chosen supplier. Prices charged for delivery include packaging and drop off or pick up.
The email address and/or mobile number you provide during the checkout process may be entered into the Royal Mail delivery system in order for you to keep track of your order and to make it easier for you if redelivery is required.
If you require another method of delivery, please contact us in advance of placing your order.
8. Returns and Refunds:
You have the right to change your mind about your purchase, if this is the case please contact us to let us know that you will be returning your order (this will be at cost to you and must be returned using Royal Mail Special Delivery). We can provide the return address during correspondence. All items must be returned in original condition and unused within 7 days and we will offer you an exchange or refund once they have been received and checked. Due to health and hygiene regulations, we cannot accept the return of earrings unless they are faulty.
This does not affect your statutory rights.
In the unlikely event you receive an item that is damaged or defective please contact us within seven days of receiving the item. We will work with you to resolve the issue as quickly as possible by replacing the item or offering a refund for the item. The faulty item will need to be returned to us.
9. Your Conduct:
You explicitly agree, in using this website or any service provided, that you shall not:
(a) provide any content or perform any conduct that may be unlawful, illegal, threatening, harmful, abusive, harassing, stalking, tortious, defamatory, libellous, vulgar, obscene, offensive, objectionable, pornographic, designed to or does interfere or interrupt this web site or any service provided, infected with a virus or other destructive or deleterious programming routine, give rise to civil or criminal liability, or which may violate any applicable local, national or international law;
(b) impersonate or misrepresent your association with any person or entity, or forge or otherwise seek to conceal or misrepresent the origin of any content provided by you;
(c) collect or harvest any data about other users;
(d) provide or use this website and any content or service in any commercial manner or in any manner that would involve junk mail, spam, chain letters, pyramid schemes, or any other form of unauthorized advertising without our prior written consent;
(e) provide any content that may give rise to our civil or criminal liability or which may constitute or be considered a violation of any local, national or international law, including but not limited to laws relating to copyright, trademark, patent, or trade secrets.
10. Third-Party Services:
As this website is hosted on a third-party, site, this means that goods and services of other third parties may be advertised and/or made available on or through this website. Representations made regarding products and services provided by third parties are governed by the policies and terms made by these third parties. We shall not be liable for or responsible in any manner for any of your dealings or interactions with these third parties. These adverts are not validated, endorsed, sponsored or supported by Blue Mango Creations.
11. LIMITATION OF LIABILITY:
YOU EXPRESSLY UNDERSTAND AND AGREE THAT WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSS, RESULTING FROM OR ARISING OUT OF (I) THE USE OF OR THE INABILITY TO USE THE SERVICE, (II) THE COST TO OBTAIN SUBSTITUTE GOODS AND/OR SERVICES RESULTING FROM ANY TRANSACTION ENTERED INTO ON THROUGH THE SERVICE, (III) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA TRANSMISSIONS, (IV) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE, OR (V) ANY OTHER MATTER RELATING TO THE SERVICE.

You agree that this Terms of Use and any dispute arising out of your use of this website or our products or services shall be governed by and construed in accordance with local laws where the headquarters of the owner of this website is located, without regard to its conflict of law provisions. By registering or using this website and service you consent and submit to the exclusive jurisdiction and venue of the county or city where the headquarters of the owner of this website is located.
